International Trade Agreements With Environmental Components

The problem should not be exaggerated. So far, the GATT-WTO system has not called into question measures that affect trade and that have been taken within the framework of an international environmental agreement. It is also widely accepted that measures taken under an environmental agreement are unlikely to become a problem in the WTO once the countries concerned have signed the environmental agreement, although the issue is not fully resolved. The Committee on Trade and Environment is more concerned about what happens when one country invokes an environmental agreement to act against another country that has not signed the environmental agreement. Technical barriers to trade (product and industry standards) and sanitary and phytosanitary measures (animal health, plant health and hygiene): explicit recognition of environmental objectives. 185. With these conclusions, I wish to underline what I did not decide in this appeal. We have not decided that the protection and preservation of the environment is of no importance to WTO members. Is that clear. We have not decided that sovereign WTO member nations will not be able to take effective measures to protect endangered species, such as sea turtles. Of course, they can and should. And we have not decided that sovereign states should not act bilaterally, plurilaterally or multilaterally, either in the WTO or in other international for a, to protect endangered species or otherwise protect the environment.

Of course, they should and do. This case still attracts a lot of attention, as it has an impact on environmental disputes. It was dealt with under the old GATT dispute settlement procedure. The key issues are: the Committee affirms that the Agreement on trade aspects of intellectual property rights (TRIPS) helps countries to preserve environmentally friendly technologies and products. Further work is planned, notably on the relationship between the TRIPS Agreement and the Convention on Biological Diversity. Agriculture: environmental programmes exempted from subsidies The Committee considers that further work is needed to study the link between the General Agreement on Trade in Services (GATS) and environmental protection policy in this sector. At the same time, the eventual opening of Arctic shipping routes could also have positive economic repercussions on shipping, but at the expense of environmental degradation. The expansion of global trade and the increasing integration of global value chains raise questions about how trade and the environment interact. What is the impact of trade on the environment? And vice versa, how can the evolution of the natural environment (e.g. the effects of climate change) change trade patterns? Is trade liberalization good or bad for the environment? What are the short- and long-term consequences and can an optimal mix of trade and environmental policies reap the benefits of trade while minimising environmental costs? Labelling environmentally friendly products is an important environmental instrument….
